[Boro Inc.] ("Boro") provides the marketplace platform only. Boro is not a party to this Agreement.

1. The rental

The Owner agrees to make the item available to the Renter for the Rental Period, and the Renter agrees to pay the total above and return the item in the same condition as received (allowing for normal wear), cleaned if applicable, at the agreed time and place.

2. Boro is the venue, not a party

The Parties agree that this is a rental contract solely between the Owner and the Renter. Boro operates the marketplace, processes payments, and offers optional damage protection, but Boro does not own the item, does not inspect or warrant it, and is not a party to this Agreement. Any claim arising from the rental is between the Parties, not against Boro.

3. Condition and inspection

The Renter has had (or had the opportunity to have) the item described and photographed in the listing. The Renter must inspect the item at pickup and report any pre-existing damage through the Platform before use. Damage not reported before use is presumed to have occurred during the Rental Period. The Owner warrants that the item is as described and that any known defect or safety issue has been disclosed.

4. Proper use

The Renter will use the item only for its intended, lawful purpose, following the listing description and the Owner's reasonable instructions. The Renter will not sublet, lend, modify, disassemble, or attempt to repair the item without the Owner's prior consent through the Platform.

5. Damage, loss, and theft

The Renter is responsible for loss of, theft of, or damage to the item during the Rental Period, beyond normal wear and tear, up to the item's declared value above. If damage protection was purchased, accidental damage is covered under Boro's damage-protection terms up to the declared value; intentional damage, misuse, loss, and theft are not covered by damage protection. Damage must be reported through the Platform within 48 hours of return, with photos. Boro's determination of a damage claim is final for purposes of the Platform.

6. Assumption of risk

Both Parties acknowledge that using physical items carries inherent risks of personal injury and property damage. Each Party assumes the risks arising from their own participation in this rental and is responsible for their own safety and for using the item safely and lawfully.

7. Waiver and release

To the maximum extent permitted by applicable law, each Party waives and releases any claims against Boro and its directors, officers, employees, and agents arising out of or relating to this rental, including claims for personal injury, property damage, or economic loss — except where caused by Boro's gross negligence or wilful misconduct, or where the law does not permit such a waiver.

8. Indemnification

Each Party agrees to indemnify and hold harmless Boro and its directors, officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from that Party's breach of this Agreement, misuse of the item, or violation of law in connection with this rental. This does not apply to the extent a claim arises from Boro's own gross negligence or wilful misconduct.

9. Limitation of liability

To the maximum extent permitted by applicable law, Boro's total liability relating to this booking is limited to the service fee Boro collected for this booking. Boro is not liable for indirect, incidental, or consequential damages. Nothing in this Agreement limits liability that cannot be limited under applicable law.

10. Payments, cancellation, and refunds

Payment, the security hold, cancellation, and refunds for this booking are governed by Sections 7 and 10 of Boro's Terms and Conditions in effect at booking: free cancellation up to 24 hours before pickup; within 24 hours, a fee of one day's rental applies. The Renter authorizes Boro's payment processor to place the security hold and to collect late-return charges at the daily rate.

11. Disputes

The Parties will first try to resolve disputes directly through the Platform's messaging. Either Party may escalate to Boro within 14 days after the Rental Period ends; Boro may mediate and issue a determination on refunds, claims, fees, or holds that is binding for purposes of the Platform. Boro's involvement does not make Boro a party to this Agreement.

12. General

This Agreement, together with the booking details above and Boro's Terms and Conditions, is the entire agreement for this rental. If any provision is unenforceable, the rest continues in force. Nothing here limits either Party's mandatory rights under applicable consumer-protection law. The English version of this Agreement prevails over translations.

Acceptance

By ticking the box at checkout (Renter) or confirming the booking (Owner), each Party confirms they have read this Rental Agreement, agree to be bound by it for this booking, and accept the booking details above.
